said John Short shall pay on or before the seventh day of September A. D. 1860 to the said Charles F, Wenner the full amount of three promissory notes including interest thereon as herein described, to wit: one of said note for the sum of five hundred and fifty dollars and forty three cents, with interest, dated 2nd day of January 1854, one of said notes for the sum of five hundred and seven dollars and thirty five cents, with interest, dated January 1st 1856 and the third and last note for the sum of six hundred dollars with interest, dated September 5th 1857, then this mortgage shall be void: and the said John Short covenants that he will pay the aforesaid money and be further covenants that in default of payment the said Charles F, Wenner May inter, Provided that until default of payment, the said John Short shall possess the premises, and provided that if default shall be made in the payment of the money aforesaid, or the interest thereon, at the time or in the manner aforesaid, then it shall be lawful for the said Charles F, Wenner to sell the said mortgage premised, on the premises by public auction for cash, after giving at least three weeks public notice of the time , place , manner and terms of sale in one or more newspapers published in the city of Frederick, at least once a week for three successive weeks prior to the day of sale, to pay the debt, and the surplus if any, over to the said John Short.
