At the request of Joseph Waltman the following deed was recorded day of August 1845.

(it being part of a tract of land called "Hawkin's Merry Peep a Day" and deeded within the following courses and distances to wit: Beginning ____ said parcel off land at a stone now planted on the Southern side of the C & O Canal and at the end of 25 1/5 perches on a line drawn south 77? W from the 55th mile post on the said canal standing above 3 1/2 perches above the upper end of Lock

canal N. 72 degrees W. 248 perches to a stone now planted N 62 1/2 degrees W 35 perches to a stone now planted near a culvert then South 10 degrees W 9 perches to the mount of a gut and also to the northern edge of Potomac river then down by _____ the meandering of said river the __ following courses and distances to wit: . . .

(The ___ description is from a survey of the said parcel of land made by ___ Survey of Frederick County in June 1844) "It is understood however between the parties to this indenture that the right is reserved to the party of the final part to take at any time and all times hereafter ____ any payment therefore from one acre of the aforedescribed parcel of land such ______ and guantity of earth and materials as in the opinion of the said party of the first part may be required for this repair of the adjoining embankments of the C & O Canal which ___ acre shall be on the eastern side of the branch or outlet leading to the river from the canal culvert nearest to and above Berlin and be so located ahead of . . ..
