Hon. Sammuel Hambleton Pres of Ches. & Ohio Canal Co. Dear sir: I take the liberty of addressing you in your official capacity to ask your assistance and authority to address what is no inconsiderable grievance to me. I am engaged in converting for market a large body of timber lying upon your canal at the north of Catoctin Creek and have considered the canal the channel by which to convey the same to Market.
There is upon my land a basin of the canal which would
offer a convenient place of deposit for loading. filled up as to prevent boats from entering.
But it is now so There is but one
other place along my premises of approach to the canal (being cut off by the railroad) to this point I made a good wagon road not anticipating any difficulty in crossing from that work. application to them for a crossing.
But upon
I have been flatly refused for
no other reason than that it would give your "work" the benefit of the freight when the large quantity of material I have ready for market.
This is the grievance of which I complain and effort to
compel me to seek "theirs" as an outlet.
Your charter is the
original and "this nuisance" only exists by sufferance whose policy has always been to swallow up everything by monopoly.
I assert
that I have the right to cross and �hat you have the right that I should cross to your work. your position can demand it.
