Last Will and Testament

of Leonard Smith; page 2

11th: I give and bequeath to my daughter Jean Smith one Lot in the Town of Berlin No. 14 ~

12th: I give and bequeath to my son Charles Smith one Lot in the Town of Berlin No. 29 ~

13th: I will that my Executor hereafter named execute a Deed to William at Thomas for a Lot in the Town of Berlin No 31, and execute deeds for all other Lots and Lands in the town of Berlin aforesaid that are not already deeded and that may hereafter be by him disposed of.

14th: I will that after the payment of all lawful debts the remainder of my property shall be divided among my children as follows to my son John Smith two parts, to my son Charles Smith one part, to my son Joseph Smith one part, to my daughter Mary Jameson one part, to my Benjamin Smith one part, to my son Raphael Smith one part, to my daughter ___ Smith one part, and to my son Francis Smith the sum of Five shillings ---land currency

15th: I further will that if my children aforesaid cannot agree on a division as before directed then my Executors hereafter named to sell the whole of the property real & personal except the legacies before named and the money arising therefrom to be divided in the same proportion.

16th: I hereby recommend to my son John Smith aforesaid to act with brotherly kindness to his brother Francis J. Smith as far as his circumstances may justify the same

17th: I do also will and appoint my son Joseph Smith aforesaid to be my whole & sole executor of this my last Will and Testament ~

18th: I do also give and bequeath to my son Joseph Smith aforesaid all that Tract of land called the Rival, not included in the lines of a Track of land called Victory any thing above mentioned to the contrary notwithstanding ~

19th: I likewise will the use and possession of a part of thenWare House near the Town of Berlin to Messrs Beall & Nesmith for the term of Five years from the first day of January next on payment of the Yearly Rent of Twenty pounds Maryland Currency ~

In Testimony whereof I do hereby set my hand & seal this 18th day of March 1794.
