connection between the Baltimore and Ohio Rail Road and the Winchester and Potomac Rail Road; and the said parties of the first part do hereby further grant bargain and assign to the said parties of the second part the right and privilege of laying down and constructing in such
manner as the said parties of the
second part may deem proper a single track of wood and iron upon either carriage way of the present Bridge at Harpers Ferry and also upon the land of the said parties of the first part at either and both extremities of said present bridge the parties of the first part here to have the liberty of charging toll on said present Bridge as before the date hereof but to charge no toll upon Rail Road Cars nor upon the passengers or commodities therein contained belonging to the said parties of the second part or to the Winchester and Potomac Rail Road Company which may cross upon said track when laid down on said present Bridge neither is any toll to be charged on the workmen and persons engaged in laying down repairing or recovering or renewing the said track on said bridge while passing to and fro during the construction repairing recovering or renewing the same neither on the agents of the said parties of the second part and of Winchester and Potomac Rail Road Company after the said track shall
be laid down upon the said present bridge neither is
any toll to be
such person agents or officers during the
construction of the new Viaduct before mentioned the said parties
