act which shall at any time obstruct the travel thereon or the use thereof by the public it being expressly understood that nothing herein contained is to authorize any in intrusion or interference with that part or side of said viaduct which is intended to be exclusively occupied by the track or rails of the said rail way of the said parties of the second part it being understood that the said parties of the first part are to have nothing whatever to do with the said viaduct further than to receive as far as they may lawfully do, the tolls herein mentioned and it being also expressly understood that if

said present bridge or any one arch or division shall break down or fall in or be destroyed by fire or other agency before the said viaduct shall be begun or if begun not completed it shall be deemed a full compliance with the terms of this agreement of the parties of the second part proceed to construct forthwith or to complete as speedily as they can the said-viaduct without rebuilding the said present bridge or said arch or division and it is further understood between the parties hereto that nothing herein contained shall prevent the abutment or the ground on which the same is erected on the Virginia shore from reverting according to their several interests to the said parties of the first part whenever the said bridge shall cease to be used as such as is herein provided and when the said bridge shall cause to be so used the abutment on the Maryland shore or the ground in
