At the request of the Baltimore and Ohio Rail Road Company the following Deed was recorded March 20, 1840. This Indenture made this second day of December in the year of Our Lord One Thouusand Eight Hundred and Thirty Nine between Gerald B. Wager and the Baltimore and Ohio Rail Road.... Now therefore this indenture witnesseth that the said parties of the first part for and in consideration of the sum of five thousand dollars to them in hand paid by the said parties of the second part at and before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged have given granted bargained and sold assigned transferred and conveyed and by these presents do give grant bargain and sell assign transfer and convey to the said parties of the second part their successors and assigns all the interest of the said parties of the first part as proprietors of the Harpers Ferry Bridge either in the old bridge excepting the Virginia abutment and the materials of the old bridge or in the wagon way attached to the present rail road viaduct together with the right to take toll and all rights incidental either to the original ferry or derived under the laws of Virginia and Maryland or either in relation to the old bridge at Harpers Ferry or to said viaduct so as to substitute the said party of the second part in all respect in the place of the said parties of the first part as bridge proprietor as aforesaid so far as said Bridge and Viaduct are
