concerned and all rights incident and belonging to them.

And the

said parties of the first part further convey to the extent of their interest therein to the said parties of the second part the right of way for a branch turn out and switch with two tracks from the main stem of the Baltimore and Ohio Rail Road as proposed to be constructed on the Virginia Shore of the Potomac River in front of and on the river side of the said Virginia abutment to the lot now owned by the said party of the second part between the said Virginia abutment and the present rail road viaduct to have and to hold the property and rights hereby described and hereby intended to be granted bargained and sold and conveyed to the said parties of the second part their successors and assigns forever and to and for their own use and behoof.

And this indenture further of Witnesseth that in

pursuance of the agreement with the said Gerald B. Wager as aforesaid and for the purpose of carrying the same into full effect and for the consideration herein before mentioned to be paid, the said parties of the first part do hereby release all claim for damages for right of way that they might have or claim by reason of the construction of the main stem of the said Baltimore and Ohio Rail Road in front of the United States Wall and Shops at Harpers Ferry and the prolongation thereof up and down the Potomac on a line with the said United States Wall and down the river until the said main stem is united to the present
