And the said parties of the first part do here by

further release all claims they might or could have against the said party of the second part by reason of a contract heretofore entered into with the said party of the first part on the sixth day of July in the year One thousand eight hundred and thirty five.

And it is understood between the parties hereto and the

said parties of the first part to the extent of their interest therein hereby agree to take down or cause to be taken down and removed the first arch at least of the old bridge at Harpers Ferry in time to allow the construction of the main stem branch and turn out aforesaid without inconvenience or interruptions and it is hereby declared.by the parties hereto that a part of the consideration of this indenture is the assumption by the said parties of the second part of the Virginia Shore of the Potomac River for the route of the said main stem on the location in front of the United States Wall aforesaid and connected with the present viaduct as already mentioned.
